Botswana: President Duma Boko and his commitment to a historic judicial reform to strengthen the rule of law

Botswana’s President Duma Boko has made judicial reform a central pillar of his governance. During his State of the Nation address, he stressed that judicial reforms, as well as forensic audits or educational innovation, reflect the country’s determination to uplift its people and secure its future.

At the heart of this ambition is the creation of a Constitutional Court, a project that has taken a decisive step forward with the adoption of the draft constitutional law by Parliament. President Boko defended this institution as a key instrument to strengthen Botswana’s democratic system and judicial process. He stressed that it is indispensable for the protection of the rights of all residents and for the establishment of a clear path for the urgent and coherent treatment of constitutional issues. The court must ensure that all institutions operate within the constitutional framework, thereby protecting vulnerable groups, promoting equity in governance, and ensuring accountability. The Minister of Justice said that this measure aims to strengthen democratic ethics, protect human rights and speed up the processing of pending constitutional cases.

An important step towards preserving judicial independence has been taken with the adoption of provisions to ensure a transparent and non-politicized judicial appointment process. The President, acting on the advice of the Judicial Service Commission, can only formalize the decision of this independent body. The assistant minister explained that this method, which excludes the president from the substantive power of appointment, is an essential guarantee to preserve independence, impartiality and the separation of powers.

This reform is part of President Boko’s long-standing commitment to civil liberties. A former lawyer pleaded at a conference of judges in Southern Africa for judicial systems to strengthen their independence, describing them as the foundation of democracy and socio-economic progress. He stressed that socio-economic development can only be achieved within the framework of a robust, transparent, predictable and enforceable legal system. Through this reform, President Duma Boko affirms his desire to transform Botswana into a country where integrity is the foundation and where justice is accessible to all.
